HostingDude Inc CONSOLIDATE EXPIRATION CONSOLIDATION AGREEMENT
This HostingDude Inc ConsoliDate Expiration Consolidation Agreement ("Agreement") is by and between HostingDude Inc ("HostingDude Inc"), a/an individual and you, your heirs, agents, successors and assigns ("You"), and is made effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your use of HostingDude Inc's ConsoliDate Expiration Consolidation Services (the "Services") and represents the entire agreement between You and HostingDude Inc. By using the Services, You acknowledge that You have read, understand and agree to be bound by all the terms and conditions of this Agreement, and the Universal Terms of Service, along with any new, different or additional terms, conditions or policies which HostingDude Inc may establish from time to time. All HostingDude Inc policies and agreements related to Your use of this service are incorporated herein and made part of this Agreement by reference, including the Uniform Domain Name Dispute Resolution Policy (UDRP). By purchasing HostingDude Inc's services, You acknowledge that You have read, understood, and agree to be bound by all terms and conditions of this Agreement and any other policies or agreements made part of this Agreement by reference, as well as any new, different or additional terms, conditions or policies which HostingDude Inc may establish from time to time, and any agreements that HostingDude Inc is currently bound by or will be bound by in the future.
1. FEES
In consideration for the services ("Services") purchased by You and provided to You by HostingDude Inc, You agree to pay HostingDude Inc at the time service is provided. Payment is to be made by You by providing either a valid credit card, an online check, or using "Good As Gold" to establish a cash reserve for charge by HostingDude Inc (collectively, the "Payment Method"). Personal checks and money orders may only be used only to fund "Good As Gold" (GAG) accounts, must be for payments of $100 or more, and issued in U.S. dollars for the full amount required at that time. Personal checks under $1,000 are subject to the same processing fees as wire transfers. All personal checks will be delayed fourteen (14) days until the money is credited, which may delay Your usage of the product or service, and any check that bounces will result in a $25 bounced check fee. If You purchase an automatically renewing service or product by personal check, it is Your responsibility to make payment arrangements for each renewal payment. Payments are non-refundable. If for any reason HostingDude Inc is unable to charge Your Payment Method for the full amount owed HostingDude Inc for the service provided, or if HostingDude Inc is charged a penalty for any fee it previously charged to your Payment Method, You agree that HostingDude Inc may pursue all available remedies in order to obtain payment. You agree that among the remedies HostingDude Inc may pursue in order to effect payment, shall include but will not be limited to, immediate cancellation without notice to You of any domain names registered or renewed on Your behalf. HostingDude Inc reserves the right to charge a reasonable service fee for administrative tasks outside the scope of its regular services. These include, but are not limited to, customer service issues that cannot be handled over email but require personal service, and disputes that require legal services. These charges will be billed to the Payment Method we have on file for You. You may change your Payment Method at any time by logging into Your Account Manager.
2. TERM OF AGREEMENT; MODIFICATIONS
The term of this agreement shall continue in full force and effect as long as You take advantage of and use the Services. In the event You terminate Your use of the Services, HostingDude Inc will not refund any amounts You have paid for the Services. You agree that HostingDude Inc may modify this Agreement from time to time. HostingDude Inc may also discontinue the Services it provides under this Agreement. You agree to be bound by any changes HostingDude Inc may reasonably make to this Agreement when such changes are made.
3. YOUR USE OF THE SERVICES
You understand and acknowledge that the Services may only be used to consolidate the expiration of .com and .net domain names. The Services may not be used to consolidate domains that are on Registrar HOLD, Registry HOLD, or pending Transfer status. You acknowledge that the Services may only be used to push the expiration date of Your domains forward in time, at least one month forward and no more than ten years forward, and then, only for a period lasting less than 12 months. Once the Services have been used to consolidate domains, the new expiration date may not be reversed. To ensure that the Services are not abused or used as an alternative to renewals, you may only use the Services on each domain once in any 12-month period. The Services may only be used on domain names that have not passed their expiration date. In order to change the expiration date again, you will be required to renew the domain name first. You further understand and acknowledge that the Services may only be used to coordinate domains where HostingDude Inc is the registrar of record. Domains not registered with HostingDude Inc must be transferred before HostingDude Inc can perform the Service. HostingDude Inc has no obligation to monitor Your use of the Services. HostingDude Inc reserves the right to review Your use of the Services and to cancel the Services in its sole discretion. HostingDude Inc reserves the right to terminate Your access to the Services at any time, without notice, for any reason whatsoever. HostingDude Inc reserves the right at all times to disclose any information as HostingDude Inc deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in HostingDude Inc's sole discretion.
4. INTRODUCTORY PERIOD
You understand that the Services are being offered for an introductory period only and may not be offered after this introductory period expires. HostingDude Inc reserves the right to cancel the Service or discontinue offering the Service at any time and for any reason. However, any domain consolidations that You have made during Your Service shall remain in effect.
5. YOUR ACCOUNT SECURITY
When You register for the Services, You agree to complete the registration process by providing current, complete and accurate information. You are entirely responsible for maintaining the confidentiality of Your password and account information. Furthermore, You are entirely responsible for any and all activities that occur under Your account. You agree to notify HostingDude Inc immediately of any unauthorized use of Your account or any other breach of security. HostingDude Inc will not be liable for any loss that You may incur as a result of someone else using Your password or account, either with or without Your knowledge. However, You could be held liable for losses incurred by HostingDude Inc or another party due to someone else using Your account or password.
